These terms of use (the Terms of Use) regulate access to and use of the website hosted under the domain name jitkey.com (the Website) as well as the contents and services that the owner of the Website makes available to its users (the Users).

Likewise, these Terms of Use establish together with the Privacy and Cookie Policy, relating to the management of personal data of Users, the terms and conditions that govern the Website (the Terms and Conditions).

In compliance with article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the following identifying data of the Website owner are set out:

Access to the Website or its use by the User necessarily implies, and without reservations, knowledge and acceptance of these Terms and Conditions, therefore, it is recommended that the User read them carefully in case of using the services offered by JITKey.

Access and use of the Website is prohibited for Users under eighteen (18) years of age. Therefore, by accepting these Terms of Use, the User acknowledges being a person with sufficient capacity to acquire the obligations derived from their actions and that they have read, understand and accept their content.

In the event that a minor under 18 years of age registers as a User, JITKey will adopt the necessary measures for this purpose and will proceed to delete or block the User's account as well as suspend the Services.

Users who wish to use the Services offered on the Website must register on it through the form created for this purpose, for which they will have to follow the instructions indicated in it and provide the required data (the «Registration Form»).

Once the Registration Form has been completed, the User will receive an email at the address indicated in the Registration Form, to proceed with the activation of their User account (hereinafter the «Registered User»).

JITKey makes available to its Registered Users a platform through which they can contract the management of tourist accommodations (the «Services»).

1. Registration on booking platforms. JITKey will register the property on the main booking portals and will take care of their management.
2. Advertisement Optimization. JITKey will optimize your accommodation profile on the main booking platforms.
3. Optimal Price Adjustment. JITKey will update the price daily thanks to our algorithm, which takes into account various variables such as occupancy percentage in the area, competitor prices, visits from potential guests, booking history from previous years...etc., whose objective is profit maximization for the landlord.
4. Check-In/Check-Out. For the provision of the check-in service, the landlord must deliver to JITKey the necessary number of keys to the property. JITKey will take care of key delivery and provide the guest with information about the operation of appliances and tourist information, among others. After the guests' stay, JITKey will proceed to collect the keys at the indicated address, verifying the condition of the house
5. Guest communications. JITKey will carry out communications with potential guests to provide information about the property and resolve issues that may arise during the booking process. JITKey will also communicate with guests before, during and after their stay so they can enjoy a trouble-free stay.
6. Welcome Pack. JITKey may provide a breakfast service for landlords' guests. For this, landlords will be responsible for supply. For this service it is necessary to incorporate a locked cabinet into the property where food that will not be offered for that booking will be stored.
7. Cleaning service. JITKey provides cleaning services for homes after the end of guests' stay. This service includes cleaning of bathroom/s, kitchen, and room/s, in addition to sweeping and mopping the entire house and garbage removal.
8. Laundry service. JITKey offers cleaning and ironing service for sheets and towels. The laundry service includes preparation and presentation of beds and bathrooms for the next booking.
9. Supplies. Don't worry about toilet paper, cleaning products... All consumable items will be replaced by our professionals and the cost will be charged to the monthly settlement.
10. Emergencies. JITKey takes care of managing maintenance tasks that may be necessary to offer services and guarantee the guest's stay, as well as mediating with the insurance company.
11. Legalization. According to Decree 28/2016, of February 2, which regulates tourist accommodation in Andalusia, JITKey takes care of the legalization of your tourist accommodation.

JITKey offers its services without a minimum commitment period. Clients may terminate their relationship at any time by giving at least thirty (30) days’ prior notice, by emailing [email protected] or using the tool provided for this purpose in the User’s account control panel.

The client should bear in mind that once they cancel their contract, they will be responsible for future bookings. Listings and content created by JITKey while providing its services will be deleted following cancellation of the services.

These Terms and Conditions govern your access to and use of the website, the services offered and their contracting by clients, as well as all collective content, and also constitute a binding contract between you and JITKey. Please read these Terms and Conditions carefully each time you access the Website, as they may be amended.

We also recommend that you carefully read our Privacy Policy and Legal Notice, available on this website. If you do not agree with any of our policies, you will not be entitled to obtain information or continue using the website or the Services.

In addition to the other warranties set out in these Terms and Conditions, the client guarantees compliance with the following clauses:

1. The client is the owner or a lessor with full authority to contract JITKey’s services under the terms of this Agreement.
2. The client acknowledges and agrees that JITKey may subcontract the proposed services.
3. The client acknowledges that JITKey is not a party to any agreement signed between short-term rental property lessors and guests, nor is it a real estate agency, agent or insurer. JITKey has no control over the conduct of lessors, guests and/or other website users, services offered by third parties or the condition of the accommodation, and disclaims all liability in this respect to the fullest extent permitted by law.
4. The client is solely responsible for all communications and interactions with potential guests on a property booking platform. JITKey disclaims any liability in this respect.
5. The client is solely responsible for all listings for their accommodation on the various rental platforms and warrants that the information in all such listings is truthful and accurate. JITKey therefore accepts no liability for any breach of contract between the client and third parties, nor for errors or omissions in any of the listings offered.
6. JITKey accepts no liability for any damage or theft that may occur at the accommodation.
7. JITKey accepts no liability for evicting guests who remain in the property beyond the rental period. Likewise, JITKey will not bear any costs, losses or damage they may cause.
8. JITKey is exempt from any liability for possible consequences arising from cancellation of the accommodation by the client or guest.
9. JITKey is exempt from any liability relating to the need to relocate guests for reasons beyond JITKey’s control. However, JITKey will offer relocation to the affected guest if the need arises from a failure in the provision of our services.
10. Any fee or tax required by the competent authorities where the accommodation is located will be borne by the client.
11. The client acknowledges responsibility for maintaining the accommodation and does not hold JITKey responsible for any maintenance work required there. JITKey has no obligation to notify the client of the condition of the accommodation. However, JITKey may arrange maintenance work to ensure the contracted services can be provided correctly, and the client authorizes such arrangements. The client will bear the costs of arranging and carrying out that maintenance.
12. The cost of the cleaning service will be charged to the guest as an additional booking expense. If a booking has no cleaning charge or a charge below the agreed amount, the difference will be charged to the client. Cleaning tools and products supplied by JITKey are not included in the cleaning service price and will represent an additional cost for the client.
13. JITKey will assist the client in selecting and assessing guests for their accommodation. The client acknowledges and agrees that they are solely responsible for selecting guests according to the acceptance criteria they have specified. JITKey will assist the client in registering guests on the National Police platform. The client acknowledges and agrees that they are solely responsible for that registration.
14. JITKey may act as a mediator in a disagreement between the lessor and the guest through the resolution center of the rental platform on which the property is listed. JITKey reserves the right to participate in resolving a problem between the lessor and the guest and accepts no liability for actions taken during the resolution process.
15. As some jurisdictions have laws restricting or prohibiting short-term accommodation rentals, JITKey accepts no liability for any administrative or civil penalties that may arise for this reason. JITKey therefore recommends that the client review local, regional and national regulations and consult a lawyer about whether listing their accommodation on a rental platform breaches any regulations.
16. The client must report any dissatisfaction resulting from the incorrect provision of services offered by JITKey. If it is confirmed that a service was not provided correctly, it will be performed again at no additional charge to the client.
17. Items used by JITKey to provide its services at the accommodation must be returned if the client decides to terminate the contract, as their cost was borne by JITKey.
18. JITKey reserves the right to block the availability of accommodation if it is not in perfect condition for guests to enjoy.
19. JITKey will consult the client to arrange maintenance or emergency work to ensure the services contracted for a guest. The client will pay the corresponding costs of that work as an additional charge.

For the purposes of the provisions of current regulations relating to the protection of personal data and information society services and electronic commerce, JITKey informs the User of the incorporation of the personal data provided into an automated file created under the responsibility of JITKey, for the purpose of maintaining and managing the contractual relationship with the User, as well as information and marketing tasks for services and activities related to it.

Likewise, it informs about the possibility of exercising the rights of access, rectification, cancellation and opposition through an electronic request addressed to [email protected]. JITKey undertakes to comply with its obligation of secrecy of personal data and its duty to keep them and will adopt the necessary measures to prevent their alteration, loss, processing or unauthorized access, taking into account at all times the state of technology.

JITKey is the owner of intellectual and industrial property rights in relation to all contents and elements included in this website, and therefore they are strictly protected by the corresponding laws.

It is strictly prohibited to reproduce, copy, publicly communicate, distribute, transform or modify the elements of the website, or violate any other right susceptible to protection by intellectual or industrial property law, unless there is express authorization from JITKey of the corresponding rights or it is legally permitted.

JITKey reserves the right of admission and exclusion from the Website and Services. Any User who does not comply with the rules described above may be excluded.

Likewise, JITKey may withdraw or suspend at any time and without prior notice the provision of Services.

JITKey reserves the right to modify at any time the contents of the website, service rates, terms and conditions, privacy policy and Legal Notice, in addition to the possibility of temporarily suspending its services on the Website without prior notice. The contents and services offered by JITKey are updated periodically and we suggest that you always check the validity and accuracy of the information, services and contents referred to here.

The applicable regulations require that part of the information or communications that JITKey sends to the User be in writing. By accepting these Terms of Use, the User accepts that most communications with JITKey will be electronic. JITKey will contact the User via email or posting notices on the Website. The User consents to use this electronic means of communication and acknowledges that all notifications, information and other communications that JITKey sends electronically comply with the legal requirements of being in writing.

These Terms of Use have been prepared in accordance with the provisions of Law 34/2002, on Information Society Services and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 7/1996, of January 15, on Retail Trade Regulation, and any other legal provisions that may be applicable.

The operation and use of the Website as well as these Terms of Use are governed by Spanish legislation. To the extent permitted by law, JITKey and the User, with express waiver of any other jurisdiction that might correspond to them, agree to submit to the jurisdiction of the Courts and Tribunals that are competent.

In compliance with the provisions of Directive 2013/11/EU of the European Parliament and of the Council, of May 21, 2013, relating to alternative dispute resolution in consumer matters, and Regulation 524/2013 of the European Parliament and of the Council, of May 21, 2013, on online dispute resolution for consumer matters, we inform all Users that they may carry out their consumer claims through the online dispute resolution platform to which they can access through the following link https://ec.europa.eu/consumers/odr/
